"Cornell 7": Defense lawyer calls on AG Letitia James to step down over pre-appointment Facebook post

The lawyer for one of the seven former Cornell fraternity members accused in the alleged October 2024 gang rape at Cornell's Chi Phi house is calling on New York Attorney General Letitia James to step down from the investigation she was just appointed to lead.

Attorney Andrew Miltenberg told Fox News on Sunday that James' public statements of support for the accuser — made before she was appointed — created an "avoidable question about the appearance of impartiality."

The Facebook post at the center of it

Before Gov. Kathy Hochul removed Tompkins County DA Matthew Van Houten and named James as special prosecutor on Thursday, James had posted on her official accounts calling what the woman had "been forced to endure" "horrific and unacceptable" and telling the accuser and "all survivors": "we stand with you."

When a reporter read the post back to her at Friday's press conference and asked why she had affirmed the allegations as fact without her own fact-finding, Hochul stepped in to defend her, saying she had "every confidence" in James. James herself declined to address the substance: "I will not comment on a Facebook post."

The lawyer's argument

"There is nothing improper about expressing compassion for someone who reports a sexual assault," Miltenberg said. "But there is an important difference between supporting a person who makes an allegation and appearing to accept the factual premise of that allegation before conducting an investigation."

"The concern is whether the public can have confidence that the investigation begins without any predetermined view of the facts."

His ask: James should personally recuse herself and let an "uncommitted prosecutor" within her office — one who hasn't publicly addressed the substance — lead the investigation. He said that "would strengthen" trust in the findings, and stressed his objection was not politically motivated and did not lessen the gravity of the allegations.

Where the case stands

The Night Desk will keep tracking this case. As always: the accused are presumed innocent until proven guilty, and the only verdicts that count are the ones rendered in court.
